Terms of Use

1. Who operates JAM-yak

JAM-yak is provided by Synctech sp. z o.o., established in Poland, with a contact address at Plac Bankowy 2, 00-095 Warszawa, Poland ("we", "us"). Contact: support@jamyak.com. These Terms govern our app, website and related services. Last updated: 2026-10-29.

You must have the legal capacity to agree to these Terms. If you cannot agree on your own, a parent or guardian must agree on your behalf and provide any authorisation required by applicable law. The App Store content-age rating describes content suitability; it does not determine legal capacity or replace legally required consent. By accepting these Terms or using the service where this is legally sufficient, you agree to them. The Privacy Policy explains our data practices; it is not blanket consent to optional processing.

2. What the service provides

JAM-yak is a tool for personal musical practice. You choose a recording or supported link to import; we process that recording to generate chord references and, where available, timed words that you can follow while playing. Supported sources and processing limits are those described in the app for your plan.

Outputs can contain incorrect chords, missed words, timing differences or incomplete results. They are practice aids, not a promise of an exact transcription, an official arrangement, a copyright licence or fitness for a professional purpose. Review results before relying on them.

3. Your recordings and permissions

Import only recordings that you own or are otherwise lawfully authorised to use for the requested purpose. By submitting a recording or link, you confirm that you have the necessary rights, consents or other lawful authorisation for us and our service providers to access, process, store and play that material to provide your requested service. This includes any permissions required for the recording, music, lyrics and identifiable people in it.

You are responsible for the material you choose to import and the permissions within your control. Do not bypass access restrictions, breach a source service's applicable rules, infringe another person's rights or use the service to distribute unauthorised copies. Availability through a public link or a music subscription does not itself grant permission for every use. This does not remove obligations that the law places on us.

4. Ownership and permission to process

Rights in the original recording and music remain with their respective owners. To the extent that you are entitled to grant it, you give us a limited, non-exclusive permission to process your submission, including through service providers acting for us, solely as needed to provide the requested analysis, saved results and playback, and to operate and secure the service. This permission does not transfer ownership of the original material to JAM-yak.

Your personal edits and private uploads are not made public merely because you use the service. Processing a supported public link may reuse an existing analysis, as explained in the Privacy Policy. These Terms do not grant ownership of third-party music or lyrics in the results. Do not redistribute results unless you have the necessary rights.

We may use feedback about the product to improve it without an obligation to pay for the suggestion. This does not transfer ownership of your recordings or private musical material.

5. Our software and acceptable use

Our software, branding and original materials remain ours or our licensors'. We grant you a personal, non-exclusive, non-transferable licence to use the app and our original materials for their intended purpose, subject to these Terms and the applicable store licence. No ownership is transferred. Except where applicable law permits, you may not reproduce, distribute, sell, sublicense or commercially exploit our software or branding without written permission, or remove ownership notices.

Do not resell access, scrape the service, send abusive automated requests, evade usage or payment limits, access another person's data, impersonate someone else, send malicious code, interfere with security, or use the service unlawfully. Information and rights claims you submit must be accurate and must not mislead us or others. Restrictions on reverse engineering apply only where permitted by law and do not override rights under applicable open-source licences.

We may refuse unsupported files or links and restrict abusive or infringing use. A subscription is not permission to bypass these restrictions.

6. Guest access and saved material

Access may depend on a guest session stored on your device. Keep your own original recordings. If you lose that session, delete local application data, reinstall the app or change devices, your saved library and personal edits may become inaccessible; we do not promise transfer or recovery.

Restoring a purchase restores eligible subscription access under store rules; it does not necessarily restore a lost guest library. This distinction does not limit rights that cannot legally be waived.

7. Plans, prices and renewal

A JAM-yak Pro subscription is required for imports and the player. Before purchase, the app and Apple purchase confirmation show the applicable price, currency, billing period, renewal terms, any introductory offer and relevant plan limits. Those purchase details control; a website example does not change them.

Apple handles App Store billing. A renewing subscription continues until cancelled under Apple's rules. Cancel through your Apple Account subscription settings before the renewal or trial deadline shown by Apple. Deleting JAM-yak or a guest profile does not cancel a subscription.

Only an offer explicitly shown and confirmed for your Apple Account applies. There is no standing promise of a free trial, annual plan or unlimited processing. Price changes follow Apple's procedures and applicable law.

We may correct obvious errors in service descriptions or displayed information, subject to the purchase details confirmed by Apple and applicable consumer rights.

8. Cancellation, refunds and unavailable features

You can manage cancellation and request a refund for an Apple purchase through Apple. Eligibility is determined under the applicable store rules and law. We do not exclude mandatory rights to a refund, withdrawal, conformity or other remedies.

Cancelling renewal normally leaves access for the remainder of the paid period, subject to store entitlement status, lawful suspension and refunds. Contact support@jamyak.com if a paid feature does not work; do not send card details or passwords.

9. Changes, suspension and termination

We may update features, limits and supported sources or interrupt service for maintenance, security, legal or operational reasons. We may suspend access where reasonably needed to investigate misuse, infringement, fraud or a material breach.

Where required by law, we will give notice and provide applicable remedies for material adverse changes to a paid service. An emergency or legal restriction may require immediate action. Suspension is not a general waiver of your mandatory rights or an automatic entitlement for us to keep payment for an undelivered service.

10. Reports and intellectual-property complaints

Report alleged infringement to support@jamyak.com. Identify the work, the disputed recording, link or result, why you are entitled to complain, and a way to contact you. Provide an accurate statement and supporting information; do not send unnecessary personal documents.

We may restrict or remove material while assessing a credible claim.

11. Warranties and responsibility

To the extent permitted by law, the service and its automatically generated results are supplied without additional contractual guarantees of accuracy, continuous availability, compatibility with every source or preservation of every saved item. Statutory guarantees that cannot be excluded continue to apply.

To the extent permitted by law, we are not liable for indirect or consequential loss, lost profit or business interruption. Our aggregate liability arising from the service is limited to the amounts paid by you for it in the six months before the event giving rise to the claim.

These exclusions and the cap do not apply where unlawful, including to liability that cannot be excluded for fraud, intentional wrongdoing, personal injury, or mandatory consumer and data-protection rights. They do not shift our own legal duties to you.

To the extent permitted by law, we are not responsible for delays caused by events outside our reasonable control. Mandatory remedies for an undelivered paid service remain available.

12. Claims caused by unlawful submissions

To the extent permitted by law, you must reimburse reasonable third-party claims and direct costs caused by your knowing unlawful submission of content or intentional material breach of these Terms. This does not cover loss caused by our fault, impose a duty that consumer law prohibits, or require you to waive valid claims against us. We will give reasonable notice of a claim and an opportunity to respond.

13. Law and disputes

The governing law is Polish law, subject to mandatory consumer protections in your country of residence and the forum for disputes is the courts having jurisdiction under applicable law, including any mandatory right to bring a claim in your country of residence. Contact support@jamyak.com first so we can attempt to resolve a problem. This request does not prevent urgent action or extend or shorten statutory deadlines.

Any governing-law or forum choice remains subject to mandatory protections and court rights available to consumers in their place of residence. These Terms do not impose compulsory arbitration or a class-action waiver.

14. Apple licence, updates and general terms

For an App Store download, Apple's Standard Licensed Application End User License Agreement applies unless a valid custom licence is supplied through the store. These Terms add service conditions and do not override mandatory store terms or applicable law. We, rather than Apple, provide JAM-yak support, subject to Apple's applicable obligations.

We may provide routine service notices electronically through the app, website or contact details you provide. Any legally required form or consent remains applicable. This does not constitute consent to optional marketing.

We may revise these Terms. Material changes will be notified where required and apply prospectively. These Terms and the applicable store licence form the agreement for the service, subject to mandatory law. A delay in enforcing a term is not a waiver. If a term is unenforceable, the remaining terms continue to the extent lawful. Neither these Terms nor a translation restricts non-waivable rights. The English version is the controlling text, except where local law requires otherwise.

We may transfer our rights and obligations as part of a merger, sale or reorganisation, subject to applicable notice requirements and without reducing your mandatory rights. These Terms do not create an agency, employment, joint venture or partnership relationship between you and us.
